Access to pre-recorded video lessons, worksheets, and other materials.

User accounts for scheduling, accessing materials, and tracking progress (available occasionally based on service packages).

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice.

3. User Accounts

To access certain features, such as booking sessions or viewing pre-recorded content, you may need to create a user account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

4. Payment Terms

Payments for Services can be made via one-time payments per session, subscription or package plans (e.g., monthly or multi-session), or following a free trial. We accept payments through third-party processors such as Stripe or PayPal.

All fees are quoted in GBP (British Pounds) and are non-refundable except as outlined in Section 5.

You authorize us to charge your provided payment method for the applicable fees.

Subscriptions renew automatically unless canceled at least 24 hours before the renewal date.

We may adjust fees at any time, but changes will not apply to existing subscriptions until renewal.

5. Refund Policy

Refunds are handled on a case-by-case basis. We may offer refunds for unused services if requested in writing and approved by us. No refunds are guaranteed for completed sessions, dissatisfaction with results, or failure to attend without proper notice.

6. Cancellation and Rescheduling Policy

You may cancel or reschedule a live session with at least 24 hours' notice. Cancellations with less notice may result in full charges for the session. We will attempt to reschedule in good faith, subject to availability. Repeated no-shows may lead to termination of services.

7. Intellectual Property

All materials provided as part of the Services, including worksheets, slides, pre-recorded lessons, and other content, are owned by Energetic English Ltd. or our licensors. You are granted a limited, non-exclusive, non-transferable license to use these materials for your personal, non-commercial use only during the term of your engagement with us. You may not reproduce, distribute, modify, or share these materials without our prior written consent.

8. Client Responsibilities

To participate effectively in the Services, you must:

Attend live sessions on time with a stable internet connection and appropriate equipment (e.g., webcam, microphone).

Comply with all instructions and guidelines provided.

Behave respectfully; any inappropriate behavior (e.g., harassment) may result in immediate termination.

9. No Guarantees and Limitation of Liability

We make no guarantees regarding specific outcomes, such as achieving fluency or professional success, as results depend on your effort and circumstances. The Services are provided "as is" without warranties of any kind.

To the fullest extent permitted by law, Energetic English Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to loss of profits or data. Our total liability shall not exceed the fees paid by you in the preceding 12 months.

10. Termination

We may terminate or suspend your access to the Services at any time, without notice, for reasons including but not limited to:

Non-payment of fees.

Inappropriate behavior, such as harassment or disruption.

Failure to meet session requirements, including repeated no-shows.

Violation of these Terms.

Upon termination, you must cease using all materials and pay any outstanding fees.

11. Third-Party Services

The Services may integrate third-party tools, including:

Video platforms (e.g., Zoom, Google Meet).

Payment processors (e.g., Stripe, PayPal).

Scheduling apps or other tools.

We are not responsible for the privacy practices, terms, or performance of these third parties. Your use of them is subject to their respective terms.

12. Data Collection and Privacy

We collect personal data such as contact information, payment details, and session notes/recordings. For details, see our Privacy Policy below. By using the Services, you consent to such collection and use.

13. Dispute Resolution

Any disputes arising from these Terms shall first be resolved through informal negotiation. If unresolved, disputes shall be governed by the laws of England and Wales, and you agree to the exclusive jurisdiction of the courts in London, England.
